These Terms govern your use of the Spoteq app, smartwatch app and website (the "Service"), operated by Spoteq ("we"). By creating an account or using the Service you accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 to use the Service. By registering you confirm that you are.
2. Your account
Provide accurate information, keep your login details confidential and tell us about any unauthorized use. You are responsible for all activity on your account. You can delete it at any time in Settings → Account → Delete Account.
3. Licence
We grant you a personal, limited, non-exclusive, non-transferable licence to use the Service for personal purposes. The Service, its design, code and marks belong to us or our licensors.
4. Your content
You keep ownership of the content you post. You grant us a worldwide, non-exclusive, royalty-free licence to host, display and distribute it as needed to operate and improve the Service. You confirm that you have the rights to the content you post.
5. Screening, reporting and blocking
Content is screened automatically before others can see it. You can report any content or user, and block any user, from within the app. We review reports and act on violations. You can also report abuse at support@spoteq.com.
6. Prohibited use
Do not break the law or infringe others' rights. Do not interfere with the Service or circumvent its security, screening, reporting or blocking. Do not collect data from the Service by automated means, and do not use the Service to harm anyone.
7. Location and safety
Location, routes and live location are shared according to your privacy settings. Forecasts, spot data, live cameras and session metrics are provided for convenience only and may be wrong or out of date. Never rely on them for safety decisions. Water sports are risky, and the decision to go out is yours alone.
8. Marketplace
The marketplace lets users list gear for sale. We are not a party to any sale and are not responsible for items, payment or delivery.
9. Businesses, brands and cameras
An unclaimed business listing is factual information from public sources and does not imply any relationship or endorsement. Trademarks belong to their owners. A live camera is operated by the business or its streaming provider, and you may not record or redistribute the stream.
10. PRO
PRO is a tier of additional features, currently offered free of charge as a temporary promotion. It creates no subscription or permanent right, and we may change or end it.
- We will never charge you without a separate purchase that you make yourself.
- If PRO becomes paid, we will tell you in advance. If you do not subscribe, your account returns to the free plan and you are not charged.
- Purchases in the iOS and Android apps are made only through Apple In-App Purchase or Google Play Billing. Price, renewal, cancellation and refunds then follow the store's terms, and you manage the subscription in your store account.
- You can turn PRO off at any time in Settings.
11. Third-party services
The Service may include third-party content or links, which are governed by their own terms. We are not responsible for them.
12. Suspension and termination
We may suspend or end your access for a breach of these Terms, a legal requirement, or a risk to others. You may stop using the Service and delete your account at any time.
13. Limitation of liability
The Service is provided "as is", without warranties of any kind, to the extent the law allows. We are not liable for indirect, consequential or special damages. Any liability we do have is limited to the amount you paid us in the 12 months before the event, if any. Nothing in these Terms limits rights that cannot be limited by law.
14. Indemnity
You will indemnify us against third-party claims arising from your breach of these Terms or from content you posted.
15. Changes
We may change the Service and these Terms. We will give advance notice in the app of material changes to the Terms. Continued use after a change takes effect means you accept it.
16. Apple
If you downloaded the app from the App Store, this agreement is between you and us, and Apple is not responsible for the app, its support or claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
17. Governing law
These Terms are governed by the laws of the State of Israel. The competent courts of Tel Aviv-Jaffa have exclusive jurisdiction, subject to mandatory consumer rights.
